Catherine Enrolled Agent. Ironic, but that's the law. Maybe you can answer this question. I had not filed my taxes and owed money, but when I filed my taxes recently the IRS withheld the amount due. If I go ahead and file my taxes now do you think they will give me the amount they withheld for taxes?

There is no statute of limitations for the IRS to get paid for tax dueyou owe it until you pay it. You have three years to receive a refund, but you are not given a pass if you oweyou still owe for and they are not going to give your money back after offsetting that money from your refund.
Or am I misunderstanding what you are asking? You can try filing the return. You will not be able to use TT softwarethat software is no longer available. You can prepare the return yourself using the instructions and paper forms. To clarify, they withheld the amount I owed for from my refund, so now don't owe for anymore. If I would have filed timely in I would have been owed a refund, which I know I wouldn't receive now per the 3 year statute , but I'm wondering if I file now would they refund the amount they recently held from my refund.
It's still not clear. First you said you would have had a tax due which they took out of your refund. Now you say if you had filed a timely return you would have had a Refund. Which is it?
